1. Acceptance of Terms

By accessing or using AppyShift (“the Service”), you agree to be bound by these Terms & Conditions (“Terms”). If you do not agree to these Terms, you may not use the Service.

2. Description of Service

AppyShift is a cloud-based workforce management platform that provides tools for employee scheduling, time tracking, timeclock functionality, HR information management, attendance reporting, and related workforce operations. We may update, modify, or discontinue features at any time.

3. Eligibility

You must be at least 18 years old and legally able to enter into binding agreements to use the Service.

4. Account Registration

You agree to:

  • Provide accurate and complete account information
  • Maintain the confidentiality of your login credentials
  • Be responsible for all activity under your account

We may suspend or terminate accounts that violate these Terms.

5. Subscription & Payment

  • AppyShift operates on a subscription-based model.
  • Pricing, billing cycles, and plan details are displayed at checkout.
  • Unless stated otherwise at checkout, paid subscriptions automatically renew at the end of each billing period until canceled.
  • If a trial requires a payment method, charges begin after the trial period unless the subscription is canceled before the trial ends.
  • You may manage payment details, view invoices, or cancel through billing settings when available, or by contacting support.
  • All payments are non-refundable unless required by law.
  • Refund requests are subject to review and approval. AppyShift evaluates refund requests on a case-by-case basis and may approve, partially approve, or deny a request at its discretion based on usage, timing, and compliance with these Terms.
  • We may request additional information to complete a refund review.
  • Failure to pay may result in suspension or termination of your account.

6. Acceptable Use

You agree not to:

  • Use the Service for unlawful, fraudulent, or abusive purposes
  • Upload harmful, malicious, or misleading content
  • Attempt to access systems or data without authorization
  • Interfere with the performance, security, or integrity of the Service

We may investigate and take action against misuse, including account suspension.

7. Customer Data

You retain ownership of all data you upload or generate through the Service (“Customer Data”), including employee information, schedules, timeclock entries, and HR records. By using the Service, you grant AppyShift a limited license to process Customer Data solely for the purpose of providing the Service. We do not sell Customer Data.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your information.

9. Intellectual Property

All AppyShift software, branding, trademarks, and content are owned by AppyShift and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service.

10. Third-Party Integrations

The Service may integrate with third-party tools such as payroll providers, communication platforms, and authentication services. AppyShift is not responsible for third-party services, their availability, or their policies.

11. Service Availability

We strive for high uptime but do not guarantee uninterrupted access. Maintenance, updates, or outages may occur.

12. Termination

We may suspend or terminate your account if:

  • You violate these Terms
  • You fail to pay subscription fees
  • We discontinue the Service

Upon termination, your access to the Service and Customer Data may be limited.

13. Disclaimers

The Service is provided “as is” without warranties of any kind, express or implied. We do not guarantee specific business outcomes, error-free operation, or compatibility with all devices or systems.

14. Limitation of Liability

To the maximum extent permitted by law, AppyShift is not liable for loss of data, loss of revenue or profits, or indirect, incidental, or consequential damages. Our total liability will not exceed the amount you paid in the previous 12 months.

15. Indemnification

You agree to indemnify and hold AppyShift harmless from claims arising from your use of the Service, your violation of these Terms, or your violation of any laws or third-party rights.

16. Changes to Terms

We may update these Terms at any time. Continued use of the Service after changes means you accept the updated Terms.

17. Governing Law

These Terms are governed by the laws of the State of Kansas, unless otherwise required by your local jurisdiction.
